P sued D in Small Claims Court to recover "deferred compensation" and lost. Subsequently, P's attorneys sent demand letters to D for the same claims, and filed a lawsuit on it. D brought anti-SLAPP motion under Cal. Code Civ. Proc. 425.16. Anti-SLAPP covers protected free speech including statements made in anticipation of litigation contemplated in good faith and under serious consideration. Held: P's statement of intent to litigate claims that had been previously resolved against P (in the Small Claims Court) could not have been made in good faith.

Defendant is an Indian tribal-chartered corporation with headquarters in a New York Indian reservation. Defendant is wholly owned by a Native American. Defendant imported cigarettes from a tribal Indian manufacturer located in Canada into the United States, and sold a hundreds of millions of its cigarettes to an Indian tribe in California, who in turn distributed the cigarettes to the California public. Held: Based on this activity, Defendant is subject to personal jurisdiction in California courts.

Although a description or even a video of police use-of-force may instinctively lead us to form beliefs about the matter, the lawyer who prosecutes or defends such cases knows an enormous amount of work must be done before any baton strike or bullet fired can be conclusively declared justified or not.

Cal. Evid. Code § 1119 makes confidential all settlement communications in the course of a mediation, and provides that communications made "in any arbitration, administrative adjudication, civil action" made "for the purpose of, in the course of, or pursuant to, a mediation" are not discoverable and not admissible. Here, the California Supreme Court unanimously held that, in a subsequent malpractice action, the former client may not admit into evidence any communications with prior attorney in the course of mediation in the prior action.
