This is the Memorandum Imposing Sanctions by bankruptcy Judge Bruce Markell in the case of In re Blue Pine Group, Case no. BK-S-09-13274-BAM, in the District of Nevada. The judge imposed $109,528 in restitutionary sanctions against an attorney, based on Rule 9011 of the Federal Rules of Bankruptcy Procedure, becuase the attorney "continued advocacy on behalf of positions he knew or should have known to be meritless."

Bankruptcy Debtor owned a residence in Arizona. On petition date the home had no equity, but prior to bankruptcy case’s closing, the home's value increased so the equity exceeded homestead exemption. Arizona homestead statute provided exemption “not exceeding one hundred thousand dollars in value.” The Ninth Circuit held Bankruptcy Trustee could force a sale of the home in order to recover the excess equity because the Arizona statute allowed the debtors to claim an exemption interest in dollar amounts, not in specific property.
